Terms of Service

These Terms govern use of makeamarket.io and the on-chain MakeAMarket program on Solana (collectively, the "Service"). By using the Service you agree to these Terms. If you don't, don't use it.
1. What MakeAMarket is (and isn't)
MakeAMarket is a non-custodial creator-seeded prediction marketplace. Anyone can launch a binary YES/NO market by seeding initial USDC liquidity (minimum $25). Trades occur on a constant-product AMM curve where the platform itself acts as automated market maker. After the market's end timestamp, an outcome is resolved per the rules the creator published, and holders of the winning side redeem their share for USDC.
MakeAMarket is not a securities exchange, broker-dealer, money services business, sportsbook, or investment advisor. MakeAMarket does not endorse, vet, or guarantee any market or any outcome.
2. Eligibility
You must be at least 18 and legally able to enter contracts in your jurisdiction. You are responsible for complying with your local laws — including securities, gambling, sanctions, and tax laws. Residents of jurisdictions where prediction markets or event-contract trading is restricted (including US states that prohibit it) must not use the Service.
3. Wallets and self-custody
MakeAMarket is non-custodial. You sign every transaction with your own Solana or EVM wallet. We never hold or have access to your funds or keys. Lost keys = lost funds, and we cannot help recover them.
4. Fees
- Trade fee: 1% of every buy and sell, split 0.75% platform / 0.25% market creator.
- Creator seed: the initial USDC you deposit when creating a market. This funds the AMM curve and is recoverable through trading and redemption like any other position; it is not a flat fee.
- Solana network and priority fees are paid separately by the user.
5. Market resolution
Each market specifies plain-English resolution rules and an end timestamp before it goes live. After the end timestamp passes, the market enters a resolution window:
- The creator (or, if the creator does not act, the platform) submits the YES/NO outcome based on the published rules.
- If the market is materially ambiguous, contested, or a referenced source has changed since launch, the platform may flag the market as Unresolvable. In that case, all participants redeem their position pro-rata against the curve reserves.
- Resolution is final once committed on-chain. We do not run an appeals process beyond the on-chain dispute window.
6. No financial advice
Information on makeamarket.io — including market prices, implied probabilities, comments, and creator notes — is general information only. Nothing on the site is financial, legal, tax, or investment advice. Prediction markets are highly speculative. Do not put in more than you are willing to lose entirely.
7. Acceptable use
You may not use the Service to:
- Create markets on outcomes that are illegal in your jurisdiction or that violate sanctions, hate-speech, or violence-incitement laws.
- Create markets keyed to the death, health, or harm of a specific identifiable private individual.
- Create markets that infringe trademark, copyright, or impersonate real people, brands, or projects.
- Manipulate prices via wash trading, coordinated rug schemes, or false volume reporting.
- Probe, scan, or stress-test platform infrastructure without written permission.
- Reverse-engineer or scrape at a rate that degrades service for other users.
We may delist markets from makeamarket.io's frontend for any of the above. Markets live on Solana regardless of whether we display them.
8. Creator responsibility
If you create a market on MakeAMarket, you are responsible for the resolution rules, the resolution itself (or for transferring it to the platform if you cannot act), and any claims you make about the outcome being predicted. You may not promise specific returns or fixed yield to participants.
9. No warranties
The Service is provided "as is" and "as available". We make no warranty of uninterrupted operation, fitness for any particular purpose, or correctness of on-chain pricing or resolution outcomes. Solana itself can experience outages, MEV, and reorgs that affect trade pricing and timing.
10. Limitation of liability
To the maximum extent permitted by law, MakeAMarket's total liability arising from or related to the Service is limited to the greater of (a) the platform fees you paid MakeAMarket in the 30 days preceding the claim, or (b) USD $100. We are not liable for indirect, incidental, consequential, or punitive damages — including lost profits, lost funds due to user error, mis-resolution disputes, or price movements.
11. Indemnification
You agree to indemnify MakeAMarket from claims arising out of your violation of these Terms, your markets, your trades, or your use of the Service in violation of law.
12. Governing law
These Terms are governed by the laws of the State of Texas, USA. Disputes will be resolved in state or federal courts located in Texas, except where prohibited by law.
13. Changes
We may update these Terms. Material changes will be flagged on the homepage or by email. Continued use after the update means you accept the new Terms.
